Any firm order, and having been the subject of an express acceptance by our company implies for the buyer's acceptance of these terms and conditions, to the exclusion of all other provisions, including general conditions purchase of our customers.
Only written offers and referenced can engage PIERCAN society.
3. Controls price
Rates of PIERCAN company are required by the customer available and it will be sent on request. Prices are always advertised duty. Rates are updated on 1 January of each year. In case of significant increase in commodity prices during the year, tariff adjustments will be decided.
For Piercan range for orders less than 150 € HT € HT 35 processing fee will be charged.
For Plastunion range of fresh small series will be applied. These are 50 € for series 6 to 29 units and 70 € for series 1 to 5 Systems.
The PIERCAN gloves range LIVE Neoprene and natural rubber, packaging and are sold by multiple of 30 gloves, 50 gloves if sold decontaminated / sterilized.
Unless otherwise agreed, the supplier's prices are goods from the factory. by express delivery costs are borne by the customer unless this mode is due to a delay attributable to the company PIERCAN. For deliveries in France, the goods are shipped for free on orders over 1000 € HT. A € 18.17 transportation fee will be applied for orders at 1000 € HT and delivered in France. The goods, even sent Franco, always travel at the risk and peril.
The technical recommendations concerning the compatibility of elastomers with chemicals are purely indicative and do not engage the responsibility of PIERCAN. Once these items are installed or used, they are no longer guaranteed.
Gloves Returns must be accompanied by the pre-evaluation questionnaire. Otherwise the returns will not be reviewed by the Quality department (especially for security reasons our staff) PIERCAN articles Returns must be made in their original packaging.
If delivery of products not complying with the order specifications, the seller's liability is strictly limited to the obligation to replace the defective goods or make a credit to the exclusion of all damages.
In no event PIERCAN company can not be held contractually liable and the buyer can not claim for damages because of late delivery.

6. Force majeure
All the orders have a reserve allowing PIERCAN a suspension without compensation commitments in the following cases: strikes, lockouts, fire, weather and other force majeure occurring at PIERCAN as well as among its suppliers.
Invoices are payable at the registered office of PIERCAN. In general, payment may be made by check, bank transfer. The payment is made as soon as PIERCAN has full availability of funds for the sale. This is the time the bank account is definitively credited PIERCAN.
Payment terms are 30 days from date of invoice.
The advance payment does not lead to any discount.
By express agreement, the non-payment of our supplies by the deadline automatically result in:
- The suspension of deliveries,
- The immediate payment of all amounts due,
- A late penalties based on a rate equal to 3 ½ times the legal rate of interest (Article L.441-6 of the commercial Code)
- the payment of a lump sum of 10% of the debt due, as a penalty clause.
- The payment of a lump sum of 40 € without prejudice to the payment of additional compensation in case the recovery costs exceed that amount. (Decree 2012-1115 of October 2, 2012)
8. Retention of title clause
Any order to our company assumes the customer acceptance of the title retention clause in accordance with Article L.621-122 of the Commercial Code, the goods supplied remain the supplier's property until they perfect payment.If the payment is not made within the prescribed period, the supplier reserves the right to physically take the thing delivered anywhere and hands which it is located.
Upon sale of the goods before full payment to PIERCAN company, the customer agrees to inform the subsequent purchaser of the reservation of which it is assigned.
For any dispute, of whatever nature, relating to a sale of the company PIERCAN, and notwithstanding any contrary provisions, the commercial court of the seller's head office is competent. For goods for export, the applicable law is French law.
